1. Who we are
Astromidnight is the astrophotography and stargazing activity of David Cruz, carried out as a sole trader from a private observatory in São Pedro da Gafanhoeira, Alentejo, Portugal (Tax ID: 205254128). These terms apply to the website astromidnight.pt and to all services and products booked or purchased through it.
2. Services
We provide the following services, always at the observatory or another agreed location:
- Stargazing, individual or in groups;
- Portraits Under the Stars;
- Astrophotography sessions and deep-sky image-editing mentorship;
- Stargazing sessions for groups and guests of rural stays;
- Sale of photographic prints in the site's shop.
3. Bookings and payment
Session and workshop bookings are made through our booking engine (Cal.com/Cal.eu), embedded in the site or opened directly. Payment is processed at that point, through the method shown in the booking form itself. Prices shown on the site are in euros and may change without notice for future bookings — the price that applies is always the one confirmed at the time of booking.
4. Cancellation, rescheduling and bad weather
If weather conditions don't allow a stargazing, portrait or astrophotography session to go ahead, you always have the option to reschedule for another night or receive a full refund — you never lose what you paid because of clouds. You can also ask to reschedule for other reasons by contacting us with reasonable notice; rescheduling outside the bad-weather policy is assessed case by case.
5. Print shop
Each print is made to order after purchase, with a preparation time of up to 3 business days, followed by shipping (2 to 5 business days for Europe, up to 7 business days for the US and Canada, and up to 14 business days for other destinations). Payment is processed by the external checkout platform shown on each product — we do not store payment card data on our systems.
6. Taking part in stargazing sessions
Sessions take place outdoors, at night, on rural terrain. Participants should dress appropriately for the night-time cold and follow the instructions given on site, particularly regarding the handling of equipment. Minors must always be accompanied by a responsible adult. Participation is at each person's own risk, within what is reasonable given the nature of the activity.
7. Intellectual property
The photographs, text and other content published on the site are the property of David Cruz, unless stated otherwise. They may not be copied, redistributed or used commercially without prior written permission — including photographs delivered in portrait sessions, whose personal-use terms are agreed at the time of delivery.
8. Complaints
If you have a complaint, contact us directly — we resolve things far faster than any outside body. This business also has an Electronic Complaints Book (Livro de Reclamações Eletrónico), available at livroreclamacoes.pt. In the event of an unresolved consumer dispute, you can turn to an alternative dispute resolution body — see the list at consumidor.gov.pt.
9. Changes to these terms
We may update these terms periodically. The version in force is always the one published on this page, with the update date shown at the top.
10. Applicable law
These terms are governed by Portuguese law. For any dispute not resolved out of court, the court of the consumer's place of residence has jurisdiction, under applicable law.
